That last part is the real dividing line: an assistant answers a question and forgets you, while a companion is supposed to remember your week and bring it up next time. In the US the phrase now carries legal weight, because California SB 243 defines a "companion chatbot" in statute and imposes duties on the companies that operate one.

"Companion chatbot" is now a legal category
Every roundup you will read treats "AI companion" as a marketing label. It stopped being one. California SB 243 was signed on 13 October 2025 and took effect on 1 January 2026, making California the first state to write specific safety duties for this category into law. If you are choosing a platform, the statute is the most useful buying checklist available, because it tells you what a serious operator has to be doing.
What the statute counts as a companion chatbot
SB 243 defines it as an AI system that gives adaptive, human-like responses to user inputs, meets a user's social needs, shows anthropomorphic features, and can sustain a relationship across multiple interactions. All four have to be present. The law deliberately carves out customer service bots, in-game chatbots and standalone voice assistants, which is why your smart speaker and the support widget on a retailer's site are not covered.
What operators have to do
Disclose that the user is talking to AI where a reasonable person might be misled. Maintain and publicly post a protocol for handling suicide and self-harm content, with referral to crisis services, and report annually to California's Office of Suicide Prevention. Where the operator knows the user is a minor: disclose the AI status, remind them to take a break at least every three hours, and block sexually explicit content.

SB 243 also creates a private right of action: a person injured by a violation can seek injunctive relief plus the greater of actual damages or $1,000 per violation, with attorney's fees. That is why the serious platforms all added crisis-resource handling and clearer AI disclosure through 2025 and 2026. If a platform you are evaluating has none of this, it is either very new or not paying attention, and both are worth knowing before you hand it your evenings.
Three things people conflate

These get used interchangeably and they are not the same product. Choosing the wrong one is the most common reason people bounce off the category within a week.

The boundary is blurring from both directions, and the assistants are the ones moving fastest. If you mainly want scenes and variety rather than continuity, the honest answer is that AI character chat is a better fit than a companion, and it is usually cheaper.

None of these is the sad-lonely-man story the press likes. The people who stick with a companion for more than a month tend to arrive for one of these four reasons.
Company without the performance
Talking at the end of a long day without managing anyone's mood or being interesting enough to earn the conversation. This is the most common reason men in particular give, and it has very little to do with romance.
Attention without the labor
Warmth and interest that does not have to be reciprocated on a schedule. Women arriving in this category most often describe wanting somewhere the emotional work runs in the other direction for once.

Saying the awkward thing out loud first, whether that is flirting, a hard conversation, or grief. Low stakes matter here, and so does the fact that nobody is keeping score.

Before you pay
Five things to check on any AI companion app
1. Does the memory survive a restart?
Tell it something specific and unusual, close the app, come back two days later and see whether it comes up unprompted. Plenty of platforms advertise memory and ship a long context window, which is not the same thing and behaves completely differently at week four.
2. Is the talking metered?
Message credits change how you use a companion, because you start rationing. Check whether the subscription buys unlimited conversation or a bucket of messages, and check what happens when the bucket empties mid-sentence.
3. Can you export or lose it?
Ask what happens to your companion and your history if you cancel, and whether a character can be removed by moderation. People who used borrowed characters from existing franchises have lost months of conversation this way with no warning.
4. What shows up on the card statement?
Discretion is a real feature in this category. Check the billing descriptor, the sender name on the emails, and whether the app icon and notifications say what the product is.
5. Does it meet the SB 243 bar?
A published crisis protocol, clear AI disclosure, and a real age gate. Use the statute as your checklist even if you are not in California, because it is the cheapest proxy available for whether the operator takes the category seriously.
6. Is the persona yours or everyone's?
A library character was written by a stranger and is being talked to by thousands of people. A companion you designed is yours alone. Neither is wrong, but they produce very different experiences by month three, and most people only discover which they wanted after paying for the other.
